Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and Twistyest MM SL, the company operating the Zartevo marketplace ("Zartevo", "we", "us", or "our"). By accessing or using Zartevo — whether as a buyer, vendor, or visitor — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must immediately stop using the platform. Continued use after any update to these Terms constitutes acceptance of the revised version.

You must be at least 18 years of age to create an account or make purchases on Zartevo. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

If you are registering on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@zartevo.com if you suspect any unauthorized use of your account.

We reserve the right to refuse registration, cancel accounts, or remove usernames at our sole discretion, particularly if they infringe trademarks, impersonate others, or violate these Terms.

When you purchase a digital asset on Zartevo, you acquire a license to use that asset under the terms specified on the product page — you do not acquire ownership of the underlying intellectual property.

You agree not to share, redistribute, resell, sublicense, or otherwise transfer purchased assets to third parties unless the applicable license explicitly permits it. Unauthorized distribution of purchased files is a violation of these Terms and may constitute copyright infringement.

All purchases are made in the currency displayed at checkout. Applicable taxes may be added depending on your jurisdiction.

By listing products on Zartevo, you represent and warrant that:

• You own or have full rights to distribute all submitted content.
• Your products do not infringe any third-party intellectual property, trademark, or copyright.
• Your products are accurately described, functional, and of reasonable quality.
• You will provide reasonable support to buyers regarding defects or usage questions.

Vendors must complete the onboarding and identity verification process before receiving payouts. Zartevo reserves the right to reject, suspend, or remove any product or vendor account at its sole discretion, including for policy violations, quality concerns, or fraudulent activity.

Vendors are solely responsible for the accuracy of their fiscal and tax information and for complying with all applicable tax obligations in their jurisdiction.

Each product listing specifies the license type granted to the buyer (e.g., Personal, Commercial, Extended). Buyers must use assets in accordance with the license purchased. Upgrading to a broader license requires a separate purchase.

Zartevo does not claim ownership over content submitted by vendors. By listing on Zartevo, vendors grant Zartevo a non-exclusive, royalty-free license to display, market, and promote their products on the platform.

All Zartevo branding, software, design, and platform code are the exclusive property of Twistyest MM SL and may not be copied, modified, or redistributed without written permission.

All payments on Zartevo are processed securely through Stripe. By making a purchase or receiving a payout, you agree to Stripe's Terms of Service.

Vendors receive 70% of the net sale price of each transaction. Zartevo retains 30% as a platform fee covering infrastructure, payment processing, fraud protection, and marketplace operations.

Payouts are processed subject to Stripe Connect's standard schedule, typically within 7 days of the transaction clearing, once the vendor has completed identity verification and Stripe onboarding. Payouts may be withheld if there is a pending dispute, chargeback, or suspected fraudulent activity.

Digital goods are generally non-refundable once downloaded. However, buyers may request a refund within 24 hours of purchase provided the file has not yet been downloaded. This right is waived upon initiating the download.

Exceptions apply in the following circumstances:

• The delivered file is corrupted or materially different from what was described.
• The product fails to function as documented and the vendor cannot resolve the issue within a reasonable time.
• Applicable consumer protection law grants an unconditional right of withdrawal (e.g., EU Directive 2011/83/EU where the buyer has not waived that right).

To request a refund, contact us at info@zartevo.com with your order details. Zartevo reserves the right to make the final determination on all refund requests. Approved refunds are issued to the original payment method.

You agree not to:

• Upload, sell, or distribute content that infringes any copyright, trademark, or other intellectual property right.
• Sell content generated by AI models trained on copyrighted data without proper authorization.
• Attempt to circumvent, reverse-engineer, or interfere with the platform's systems or security.
• Use the platform to facilitate fraud, money laundering, or any illegal activity.
• Create multiple accounts to abuse promotions, affiliate rewards, or the refund policy.
• Harass, impersonate, or harm other users or Zartevo staff.
• Scrape, crawl, or extract data from the platform without written authorization.

Violations may result in immediate account suspension, forfeiture of pending payouts, and/or legal action where appropriate.

Zartevo respects intellectual property rights and expects all users to do the same. If you believe that content on Zartevo infringes your copyright, please submit a written notice to our designated agent at info@zartevo.com containing:

1. Your full legal name, address, phone number, and email address.
2. Identification of the copyrighted work you claim has been infringed.
3. Identification of the infringing material on Zartevo (URL or product ID).
4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
6. Your electronic or physical signature.

Upon receipt of a valid notice, Zartevo will promptly remove or disable access to the allegedly infringing content and notify the vendor. Vendors may submit a counter-notification if they believe their content was wrongly removed. Repeat infringers will have their accounts terminated.

Submitting a false or misleading DMCA notice may expose you to liability under applicable law.

Zartevo operates a curated marketplace. We review all submitted products before publication and reserve the right to reject or remove any content that, in our sole judgment, violates these Terms, is of insufficient quality, is mislabeled, or could expose the platform or its users to legal or reputational risk.

We may also suspend or terminate accounts involved in policy violations, charge-backs, or fraudulent transactions without prior notice. Moderation decisions are final, though vendors may appeal by contacting info@zartevo.com.

Zartevo offers an affiliate and vendor recruitment program. By participating, you agree that:

• You will not engage in spam, misleading advertising, or deceptive practices to generate referrals.
• You will not self-refer or refer fictitious accounts.
• Commission eligibility and rates are subject to change with reasonable notice.
• Zartevo may void commissions generated through fraudulent, incentivized, or otherwise ineligible traffic.

Affiliate payouts are subject to the same verification and commission schedule as vendor payouts.

Zartevo acts as a marketplace platform and is not the seller of record for vendor products. We do not warrant the accuracy, quality, completeness, or fitness for purpose of any third-party content listed on the platform.

To the fullest extent permitted by applicable law, Twistyest MM SL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of profits, data, or goodwill.

Our aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to Zartevo in the 12 months preceding the claim, or (b) €100.

You may close your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. License keys already issued to buyers for your products remain valid. Any pending payouts will be processed after a 30-day review period, minus any amounts owed for chargebacks, refunds, or policy violations.

We may terminate or suspend your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to users, Zartevo, or third parties.

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. For consumers in the European Union, applicable mandatory consumer protection provisions of your country of residence also apply.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory law provides otherwise.

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of Zartevo after that date constitutes acceptance of the updated Terms.
